The New Castle County Department of Land Use (NCC) and Delaware Department of Transportation (DelDOT) seek to establish a Transportation Improvement District (TID) in the Churchman’s Crossing area.

The purpose of tonight’s information session is to:

  • Provide information about TIDs
  • Present the elements that will be explored and included in the development of a Churchman’s Crossing TID
  • Solicit feedback about the proposed Churchman’s Crossing TID

For the best experience, please plan to attend this event in person where you will be able to interact with NCC and DelDOT Staff who will answer questions and receive your feedback on the specific topics presented.  Registration to attend in person is appreciated but not required.  

This event will also be broadcast live on Zoom. The Zoom meeting link will be posted to the Dept. of Land Use's official website and Facebook page on the day of the event.  (Registration is not necessary if viewing online) Those watching online are asked to submit any feedback or questions via email to: LandUse@Newcastlede.gov

The draft New Castle County Comprehensive Plan (NCC@2050) is available for review and comment. The plan can be downloaded here 

Here is how the public can participate in continuing to shape the final plan:

  • December 9th or 15th for Public Forum 3: we will be discussing the draft NCC@2050 Comprehensive Plan: Please click on your preferred date and register: 4-7pm December 9th (in-person) and 6-7:30pm December 15th (virtual).
  • Review the draft and submit your comments by January 12: follow this link to the draft NCC@2050 Comprehensive Plan on the web where you can view/download any of the plan chapters and comment by email. (If you or someone you know is not able to access through the web, please contact us and we can get you a printed copy. Email NCC2050@newcastlede.gov or call 302-395-5400.

About the draft NCC@2050 Plan

This is what readers will see in the draft plan:

  • an introductory overview of the process;
  • plan priorities, including a detailed listing of strategies for action;
  • the draft future land use map and other associated maps;
  • background on the conditions of New Castle County and analysis that informed this planning effort; and
  • summaries of the extensive public engagement efforts.
  • Some components of the draft are more specific and fully developed than others, especially the case in Chapter B (Plan Priorities and Signature Strategies) and Chapter C (Future Land Use and Implementation). Additional details will be added over the coming months.
  • The draft is the result of 11 public meetings, dozens of community and stakeholder meetings, and thousands of website and web survey interactions.

NCC Council ZOOM Meetings, Tuesday, August 31st, On Septic Ban, TDR Transparency, Flawed Master Plans, Residency Requirements, And More!

The New Castle County Council Land Use Committee Meeting on August 31 at 3 PM and the Regular Council Meeting at 6:30 PM will have several items that significantly impact Southern New Castle County. These items will be discussed in the 3 PM committee meeting and then debated again and voted on during the 6:30 PM Council Meeting.  

These include Ordinance 21-018, making the septic moratorium permanent for any Suburban Zoned Land outside the West Wing and provisions to transfer their TDRs into the west wing, Ordinance 21-050 seeks to make the TDR process more transparent and understandable to the affected public, and Resolution 21-047 for the Plan of Copperleaf at Back Creek.  
And on September 13, the New Castle County Planning Board will consider Ordinance 21-036 to adopt the Southern NCC Master Plan and other master plans into the County Comprehensive Development Plan used to guide land use policy and legislation.

TO AMEND NEW CASTLE COUNTY CODE CHAPTER 40 (ALSO KNOWN AS THE UNIFIED DEVELOPMENT CODE OR “UDC”), ARTICLE 22 (“DRAINAGE, UTILITIES, SEPTIC SYSTEMS, PARKING, LOADING, AND LIGHTING”), REGARDING ON-SITE WASTEWATER TREATMENT (SEPTIC) SYSTEMS.
SYNOPSIS: This amendment strikes the expiration date of August 26, 2021, from Section 40.22.320.D.
This ordinance makes septic moratorium permanent for areas not on sewer limiting Suburban Zoned land outside the west wing to no more than four lots, directing all growth to the proposed new sewer area in west wing growth zone. It also provides provisions for those outside the west wing to utilize Transfer of Development Rights to send additional development rights to the west wing.  
TO AMEND NEW CASTLE COUNTY CODE CHAPTER 40 (“UNIFIED DEVELOPMENT CODE”), ARTICLE 7 (“TRANSFER OF DEVELOPMENT RIGHTS AND OTHER INCENTIVES AND BONUSES”) RELATING TO THE ESTABLISHMENT OF TRANSFER OF DEVELOPMENT RIGHTS SENDING AND RECEIVING AREA MAPS
SYNOPSIS: This Ordinance provides for a public process for the development of transfer of development rights eligibility maps that are proposed to be developed and adopted as part of the New Castle County Comprehensive Plan. It also provides a market analysis be done to better understand the potential number of units that might be transferred by the private-market or with County incentives. It requires that these maps then be adopted after hearing from the Planning Board and County Council.   
TO AMEND THE 2012 COMPREHENSIVE DEVELOPMENT PLAN UPDATE FOR NEW CASTLE COUNTY TO ESTABLISH A NEW COMMUNITY MASTER PLAN ELEMENT AND AMEND THE SEWER SERVICE AREA MAP AND FUTURE LAND USE MAP FOR SPECIFIC COMMUNITY MASTER PLAN AREAS.
SYNOPSIS: This Ordinance adds a Community Master Plan element to the Comprehensive Development Plan, including specific plans for the North Claymont, Route 9, Concord Pike (US 202) and Southern New Castle areas associated amendments to the Future Land Use Map and an associated amendment to Sewer Service Areas (Map 5-1).

The Land Use Committee Meeting begins at 3PM. Public comment is towards the end of the meeting, after the "Review/Discussion".
There are two ordinances our community may find important to give public comment on. Even if you speak for 2 minutes and say why you do/do not support the ordinances, it becomes a formal record. Getting many voices on record is very important!
Ordinance 21-018: removing the expiration date from the "septic moratorium" which essentially makes it permanent, meaning all new subdivision developments in our area MUST be on sewer, which will ultimately drive higher density housing. West Wing Alliance would like council to vote AGAINST this ordinance.
Ordinance 21-050: increasing transparency to the TDR process (Transfer of Development Rights) which would require changes to development plans such as what we observed with Carter Farms and Country Club Estates to go through a review and public comment. West Wing Alliance would like council to vote FOR this ordinance.

Recommendation for giving public comment:
  • the perspectives on "transparency",
  • the wrongful claims of the detailed requirements for mapping that is not in the legislation that only asks to map "eligibility maps"
  • the discussion of the need for a market analysis
  • the discussion on backroom deals (not that the TDR agreements affecting you were done through confidential legal settlements, facilitated by the County who made a guarantee for sewer service within one year).
  • the argument to consider TDRs through the Comp. Plan process, not legislation, while the Administration is pressing legislation restrictions on septic and funding sewer without first having a comp. plan that has gone through the State and County full approval process with public hearings. Why one process for the things they don't like, and another more immediate process for the things they do like. 

The discussion around Ordinance 21-089, a Residency Requirement for certain NCC Executive appointees should be interesting - Finance Committee meeting is at 5:00 p.m. Agenda HERE and will include discussions around Library and Housing funds' allocations.

CLNCC Asks Why Is NCC Directing The State To Add CR Zoning To CCEDs In HB 18?

My first lobbying of the 151st General Assembly on behalf of CLNCC: 

Email sent March 9th to Rich Hall cc'd to Bill Dunn, and HB 18 sponsors Ed Osienski, Paul Baumbach, and Dave Sokola. I will post the NCC DLU GM's response when I recieve it.

Why is NCC directing the state to add CR zoning to CCEDs in HB 18?

Dear Rich, 

I have been meaning to reach out to you about why NCC DLU has crafted HB 18 (as I understand it, your department wrote the CCED revision bill) to include parecels zoned Commercial Regional (CR). 

No one as yet has offered to answer this question that I had put before state legislators on the committee call that you were on. I had hoped that you would have addressed the question directly in your comments to the committee that followed mine. The sponsor was not familiar with the CR clause when I asked about why the CR zoning category was suddenly to be considered for Complete Community Enterprise Districts.  

I also put the question before community members on the Sierra Club 'informational' meeting on the HB 18 legislation held after the bill was released from committee (link https://www.facebook.com/watch/live/?v=318867596207296&ref=watch_permalink). My question was unfortunately characterized as "in the weeds" and again went unanswered by the panelists (James Wilson, Peggy Schultz, Jon Kirch). 

And, in looking at the lobbying activity around the bill as reported on the Public Integrity Commission website, several New Castle County lobbyists have been speaking to legislators about HB 18 presumably on behalf of the department and the county although a quick poll of some members of council show that council had no knowlege of any of this activity. 

I hope you will finally answer my question and can give me a sufficient rationale for including CR zoning for CCEDs. I ask "Is there any specifc record plan or CR zoned parcel that is poised to move forward with a project under CCED?"

You had mentioned on the call to the House committee that the City of Newport had expressed an interest in implementing a CCED in their comp plan discussions. But Bill Dunn who attended these meetings noted that he had no recollection of CCEDs coming up in those conversations

CR zoning was deliberately excluded from consideration for CCED in the original SB 130..

By way of this email and its cc's to legislators, I will be updating my CLNCC lobbying activity report to reflect action around HB 18. 

While we appreciate the great benefits for public health etc. around this issue of walkable communities, CLNCC is perplexed at how CCED and CR zoning are a good fit. We believe the county should share their reasoning and reveal any current plans that will benefit from it.

The CR zoning inclusion was not mentioned in the bill's synopsis and so had gone unnoticed by most folks.

The update will include revised recommendations for transportation improvements, land use strategies, and other updates to guide the future of the Churchman’s Crossing area through the next 20 years.
This Virtual Public Workshop will include an overview of transportation and land use scenario planning and present preliminary results for the Churchman’s Crossing study area. These results, along with your input and feedback, will guide more detailed analysis of refined alternatives for future workshops.

WILMAPCO Virtual Public Workshop on the Churchman's Crossing Plan, 5:30PM Wednesday, September 16th (RSVP)

A virtual public workshop will be held on Wednesday, September 16th to provide an update on the Churchman’s Crossing Plan. 
The virtual workshop will take place at 5:30 p.m. (log in and registration starts at 5:00, with the presentation starting at 5:30).  
The Wilmington Area Planning Council (WILMAPCO), DelDOT, and the New Castle County Land Use Department are developing an update to the 1977 Churchman's Crossing Plan. The update will take a little more than one year to complete, with the anticipated completion in Fall 2021. This first public workshop will serve as a formal kickoff for that study as they share some preliminary background information and engage in and with the public.

Join this wonderful list of local advocates and organizations to learn more about the New Castle County Comprehensive Plan and how this document can make such a monumental impact on our daily lives in the future. Learn about what the Comprehensive Plan is, what it does, what it doesn't do, and how it can be used as a tool for justice and to build a better future, or a tool to continue the New Castle on the same path it has been on for the last 10 years. 

We need all advocates to be engaged in planning for the future of our state's largest county, but first, we need to educate ourselves and the public on the fundamentals. Expert speakers and decision-makers will be able to answer questions from the community and have an open dialogue about the importance of community engagement on this document.

Speakers will include staff from the Department of Land Use, the State Planning Office, and the Institute for Public Administration at the Biden School of Public Policy and Administration.
